SCOTUSCare is the Obituary for the US Constitution… about time

The Supreme Court ruling in King v. Burwell makes one thing very clear: the Constitution is dead and it probably has been dead for quite some time. This is clearly the case in regards to its primary purpose: to limit the scope and the power of the Federal government. Essentially the Federal government can now do anything it likes.

Traditionally the Congress had to hide behind a fig leaf statement of Constitutional justification in order to pass laws that were Constitutionally questionable. Legislation would almost always contain a clause that invoked a clause in the Constitution to justify its existence. However, in the this latest Obamacare case the Federal government failed to even do that. But no worries, the Supreme Court bent over backwards to find a justification where there was none. It took the clear meaning obtained by reading of the law, and simply ignored it because the law as written would not work in a way that was satisfactory. The Supreme Court decided to allow the Executive branch to amend Congressional legislation on its own in order to make an unworkable law workable.

Indeed words simply do not mean anything anymore. Since laws are built from words, laws mean absolutely nothing. They can be interpreted and reinterpreted by the Federal government in order to justify whatever they believe is necessary at a given moment, and the Supreme Court has indicated that there is nothing wrong with this.

This country is no longer a Constitutional Republic. I don’t know what it is, but the Constitution is dead.

    My opinion on the matter is that the United States Constitution is on life support, but that it won’t be dead until the Second Amendment is abolished and Americans willingly turn over their guns to the government.

      They won’t do it willingly. They will do it in the same way the allowed the federal government to take control of the countries health care system, the same way that gay marriage was forced upon the country, etc. It will be slow as a glacier and just as unstoppable. The Constitution is dead. Words mean nothing. Laws mean nothing. Procedures mean nothing. The USA has clearly ceased to be a Constitutional Republic. I don’t know what it is now, but the Republic is dead.

    If the Republicans cave in yet again, the Second Amendment will be in serious danger.

      The Republicans are already talking about how to give Obama what he wants. The entire charade was just a sham to try to squeeze more bribes out of Obama. Probably a good policy if your goal is to steal money from the tax payers… which seems to be the primary objective of both Democrats and Republicans.

    Do you think that if the Second Amendment gets repealed or severely limited in the next few years (instead of using the “boiled frog” strategy and doing it over decades), that it would finally make Americans get up and try fixing the country?

      No. Americans are just talkers. They will never do anything. Oh a few hotheads might get up, and they will be killed or arrested just like what is going on in Oregon. There is no hope for the USA because the American People are no longer committed to freedom; not even a significant minority. And that means the crooks are in charge and will do whatever they like with no limitations or accountability placed upon them.

        Well, then I guess that total economic collapse is the only real hope of some semblance of sanity getting restored in North America, and who knows, if it happens, it might have a knock-on effect of ending “liberalism” in other Western countries as well.

          I doubt that will happen either. Fascism has the ability to survive a long time in the absence of some sort of catastrophic event. I suspect the USSA will just continue its slow decline into meaninglessness.

            I don’t know…, America’s societal degradation seems to be be accelerating as far as I can see, and after meeting plenty of the younger Ivy League educated Americans who vacation here, I am quite confident that the next generation of American politicians will be even worse than the current one, the national debt is already over 100% of the American GDP, etc., so if a collapse happened some time in the next 20 years, I wouldn’t be surprised.
